Ministry of Electronics and Information Technology has launched a scheme, SIP-EIT. It is a scheme to provide financial support to MSMEs and Technology Startup units for international patent filing to encourage innovation and recognize the value and capabilities of global IP along with capturing growth opportunities in ICTE sector.
Who can apply?
1. The Applicant should be registered under the MSME Development Act 2006 of Government of India as amended from time to time as a MSME unit as per the criteria for such registration; Or
2. The applicant should be a registered company under the Companies Act 2013 of Government of India and should fulfill the investment limits in plant and machinery or equipment as defined in the MSME Development Act 2006 of Government of India as amended from time to time; Or
3. The applicant should be a registered STP Unit and should fulfill the investment limits in plant and machinery or equipment as defined in the MSME Development Act 2006 of Government of India as amended from time to time; Or
4. The applicant should be a technology incubation enterprise or a startup located in an incubation centre/ park and registered as a company.
Benefits:
Providing financial support for international filing in Information Communication Technologies and Electronics sector. Reimbursement up to maximum of Rs 15 Lakhs per invention or 50 % of the expenses incurred in filing patent, whichever is less.
Procedure for application:
The online application for Support for International Patent Protection in Electronics & IT will be accepted in two parts i.e. PART I and PARTII.
Part1-
1. Applicant’s information
2. Details of present invention or patent
3. Details of patent agents or attorneys.
Part2-
Upload necessary documents in PDF form-
1. Registration certificate
2. Scanned copy of last audited balance sheet
3. Copy of product brochure
4. Copy of official filing receipt (OFR) with Indian Patent Office or copy of waiver under section 39 of Indian Patent Act in case of patent application filed in countries outside India.
5. If you have applied for PCT/ Paris Convention or Direct International Filing, then upload the copy of proof of the same.
6. Upload the patent search report.
7. Attach a duly filled scanned copy of Details for transfer of e-payments, as per the format.
8. Attach a scanned copy of Declaration form duly signed and sealed as per the format.
9. A statement by the auditor of the enterprise that they fulfill the criteria of investment in plant and machinery or investment in capital equipment (as the case may be) as stipulated in the MSMED Act 2006. Upload the same.
